New law in Gambia from January 2009
- Buying land
From January 2009 it is for a non Gambians only possible to buy land in Gambia with an area of 2500 m2. If you are interested in a piece of land larger than 2,500 m2, it is only possible if you buy the land with two people (like a couple). The land can be divided into document (s) to 2,500 m2. Each person will get a private transfer ownership of land for his / her share.
- Capital gain tax
When you buy a piece off land, the seller has to pay income tax. “The capital gain tax”. This tax is 15% of the sale. Previously there was the price of limiting the tax to the seller, a fictional sales amount specified. The government of Gambia has been this long time been aware since last year and has already begun to make this change. From January 2009 is therefore a new law.
With the sale of land is still 15% income tax to be paid. The tax office uses to calculate the income tax now has its own formula. Each area / village in Gambia now has its own price for land. About that price, you pay 15% income tax.
Example
For the place Sambuya in Gunjur is a price of 50 Dalasi per m2. If you sell a piece of land of 2000 m2, the value of the land, 100,000 Dalasi. You have to pay dalasi 15,000 Income Tax.
